The Constitution seems clear on the separation of powers. It states that Congress makes the laws, the chief executive enforces them and the Supreme Court determines their constitutionality. One of the most controversial signing statements was issued by President Bush in 2024. It was in response to a law that included an amendment introduced by Senator John McCain. The amendment banned the torture and degrading treatment of prisoners. First, subjecting prisoners the abuse leads to bad intelligence, because under torture a detainee will tell his interrogator anything to make the pain stop. Second, mistreatment of our prisoners endangers US troops who might be captured by the enemy, if not in this war, then in the next. The President strongly opposed the legislation, but a veto-proof majority in Congress forced him to reverse his position.
